Drug & Alcohol Policy

 
Terms 

Drug and alcohol abuse contribute to billions of loss of productivity and thousands of work place injuries every year. Our policy is to offer a work force free from alcohol abuse or the use of illegal drugs.  

Nimblers are expected to report to their shift on time and in appropriate mental and physical condition for work. It is our intent to provide a drug-free, healthful and safe work force and to encourage responsible service of alcohol in occasions where it is served at Nimblers shifts. 

The distribution, possession or manufacture of any prohibited or prescription drug while at work, in the workplace, using work resources or any time the Nimbler is representing Nimbly is prohibited.   

Nimbly also cautions against use of prescription or over-the-counter medication which can affect Nimblers’ workplace performance. Please inform your supervisor prior to working under the influence of a prescribed or over-the-counter medication that may affect your performance. 

Nimblers are encouraged to talk to us or their supervisor whenever they feel their safety or others’ may be at risk due to drug related issues in the workplace. 

Any serious breach of these terms will lead to termination and deletion of the users’ accounts from the Nimbly platform. 

Our company will make every effort to assist Nimblers who wish to seek treatment or rehabilitation for drug and alcohol dependency. Conscientious efforts to seek such help will not jeopardize any Nimblers’ job and will not be noted in any personal record.

Nimblers subject to testing: 

There are many reasons why a client should be interested in background checks and drug tests. First and foremost is safety to the company, its clients, and its workers. Secondly is to ensure that the candidate has been honest in their disclosures and to verify good character of the potential candidate.   

A lack of background checks or drug tests, or even poorly completed checks, could lead to potential crime, injury, or monetary loss within the company. Clients have the right to know about the candidates they are about to engage in a legal relationship with.  

Here at Nimbly, drug testing can be requested by the Nimblers themselves (a) or by the clients (b). 

(a) Nimblers who wish to show the drug-free badge on their profile can request to undergo a drug test. This will help clients chose the right person for their high-risk or safety-sensitive jobs. Only negative results will grant the drug-free baged. 

(b) In case clients specifically need Nimblers who had been drug tested but they can’t find anyone on the website with the drug-free badge, then, they can request the applied candidates to take a drug test. That condition should have been written on the job description at the time of publication of the post. 

Under Nimbly’s drug testing policy, current and prospective Nimblers who work or would work in high risk or safety-sensitive positions can be asked to submit to drug testing. No prospective employee will be asked to submit to testing unless an offer of employment has been made. 

Safeguards: 

Nimbly’s drug testing policy is intended to comply with New Zealand’s laws governing drug testing and is designed to safeguard Nimblers privacy rights to the fullest extent of the law. (not sure about this one) 

Tested substances: 

Nimbly’s drug testing program is limited to testing the urine sample for: cannabinoids, opiates, amphetamines, methamphetamine, cocaine and benzodiazepines (and others if applicable). 

 Confidentiality: 

We will make the effort to keep the results of drug tests confidential. Only persons with a need to know the results will have access to them. Nimblers will be asked for their consent before the tests are conducted. 

When Nimblers self-request drug tests and the results are non-negative, they will be asked to repeat the test another time in order to be granted the badge. At no times the results will be publicly disclosed. 

In the instances of non-negative results for the tests Nimblers agreed to take by client’s request, the results will be communicated to the client and it will be up to the client’s discretion to continue with the hire process or pre-screen other candidates.  

Costs: 

Nimblers will pay the cost of any drug testing when they request the drug-free badge to be displayed on their profiles.  

When the client requires the candidate to take a drug test, then Nimbly will cover the costs. Any additional test that the Nimbler or the client request (in the case of laboratory confirmation tests) will be paid for by the requestor. 

Drug tests are coducted by Nimbly’s certified drug collectors.
